377th SFS to enforce no texting laws Published March 6, 2014 By 377th Security Forces Squadron KIRTLAND AIR FORCE BASE, N.M. -- New Mexico recently passed a law that makes texting while driving illegal all across the state, and the 377th Security Forces Squadron will be strictly enforcing the law. "It should not be a big surprise on base, as there has been Department of Defense guidance in place for several years," said Monte Waters, 377th SFS crime prevention unit. Waters said the most significant change on base is that civilians will receive a DD Form 1805 violation that will result in a fine as determined by Magistrate Court. Active duty personnel will still be issued a DD Form 1408. Once the law takes effect July 1, a driver can be pulled over if seen looking down at his or her phone. There are no other laws that have to be broken, so the stop can be made as an isolated violation. The first violation will be $25 and the second will be $50, and each infraction will be considered a moving violation. New Mexico joins ranks with 41 other states with similar laws.
